Terms of Service

Please read these terms carefully before using our hydrogeological services. By accessing or using timhollo.com, you agree to be bound by these terms.

1. Services and Scope

Timhollo.com Hydrogeological Services provides deep-well drilling, exploratory boreholes, digital piezometer installation for continuous groundwater table monitoring, and soil permeability assessments at industrial construction sites. Our deliverables include comprehensive stratigraphical profiles essential for structural dewatering and pile foundation design.

All services are performed in accordance with applicable industry standards and regulatory requirements. The specific scope of work for each project is defined in a separate service agreement executed between Timhollo and the client.

2. Client Responsibilities

The client agrees to provide accurate and complete information regarding the project site, including existing utilities, subsurface conditions, and any known hazards. The client is responsible for obtaining all necessary permits and access rights required for the performance of services.

  • Provide safe and unobstructed access to the drilling and monitoring locations.
  • Disclose any known environmental or safety concerns at the site.
  • Cooperate with Timhollo personnel to schedule work and provide necessary site support.
3. Intellectual Property and Data Ownership

All stratigraphical profiles, groundwater monitoring data, soil permeability assessments, and related reports prepared by Timhollo are the exclusive property of Timhollo until full payment for the services has been received. Upon full payment, the client receives a non-exclusive, perpetual license to use the deliverables for the specific project for which they were created.

Timhollo retains the right to use anonymized, aggregated data for research, quality improvement, and marketing purposes, provided that no confidential client information is disclosed.

4. Payment Terms

Fees for services are as set forth in the applicable service agreement. Invoices are due within 30 days of the invoice date unless otherwise agreed in writing. Late payments may incur a service charge of 1.5% per month or the maximum rate permitted by law, whichever is lower.

All prices are in Indian Rupees (INR) unless otherwise specified. The client is responsible for any applicable taxes, duties, or levies.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Timhollo's total liability arising from or related to the services or these terms shall not exceed the total fees paid by the client for the specific project giving rise to the claim. Timhollo shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or project delays.

The client acknowledges that subsurface conditions are inherently variable and that the stratigraphical profiles and assessments provided are based on the specific borehole locations and testing methods employed. Timhollo does not guarantee that conditions at uninvestigated locations will be identical.

6. Termination

Either party may terminate a service agreement with 30 days' written notice. In the event of termination, the client shall pay for all services performed and expenses incurred up to the effective date of termination. Timhollo may terminate any agreement immediately if the client breaches these terms or the service agreement and fails to cure such breach within 10 days of written notice.

Upon termination, the client must return or destroy all confidential information of Timhollo, and Timhollo shall deliver any completed deliverables for which payment has been received.

7. Changes to Terms

Timhollo reserves the right to modify these terms at any time. Changes will be effective upon posting the updated terms on timhollo.com. Continued use of the services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

8. Governing Law and Dispute Resolution

These terms and any disputes arising out of or related to the services shall be governed by the laws of India. Any dispute that cannot be resolved through good-faith negotiations shall be submitted to binding arbitration in Mumbai, India, in accordance with the rules of the Indian Arbitration and Conciliation Act.
